Terms of Service

These terms govern your use of A/SIDE, a mobile application and related services operated by Lab 1908 ("we," "us," "our"). By creating an account, you agree to these terms.

1. What A/SIDE is

A/SIDE is a private social app for sharing photos, videos, and text with people you know. There is no public feed, no discovery, and no search. Access is by invitation only — both sides must confirm a connection before content is shared.

2. Eligibility

You must be at least 13 years old to use A/SIDE. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf. We do not knowingly allow children under 13 to create accounts.

3. Your account

• You sign in with your email address via a one-time passcode. You are responsible for maintaining access to your email.
• You may have only one account.
• You are responsible for all activity under your account.
• If you suspect unauthorized access, email hello@lab1908.com immediately.

4. Your content

You own everything you post. Photos, videos, text, captions, comments, and messages remain your intellectual property. By posting content on A/SIDE, you grant us a limited license to store, display, and deliver that content to your intended audience (your followers, group members, or message recipients) — and nothing more.

We will not:

• Use your content to train AI or machine learning models
• License your content to third parties
• Display your content to anyone you haven't chosen to share it with
• Use your content in advertising or marketing (unless you give us explicit written permission)

When you delete content, it is removed from our servers. Deletion is permanent and not recoverable.

5. Acceptable use

A/SIDE is a private space, but that doesn't mean anything goes. You agree not to:

• Post content that is illegal, or that promotes violence or harm against any person or group
• Share intimate images of anyone without their consent
• Harass, bully, threaten, or intimidate other users
• Impersonate another person or misrepresent your identity
• Use A/SIDE for commercial spam, solicitation, or advertising
• Attempt to access another user's account, data, or private content
• Reverse-engineer, decompile, or attempt to extract the source code of the app
• Use automated tools (bots, scrapers, crawlers) to access A/SIDE
• Circumvent any technical measures we use to enforce these terms
• Share your invite codes publicly or sell them

We may remove content or suspend accounts that violate these terms, at our discretion. Because A/SIDE has no public surface, content moderation is complaint-driven — if someone in your circle reports content, we'll review it.

6. Invitations and connections

• New users join by redeeming an invite code from an existing user, or by requesting to follow someone who is already on A/SIDE.
• All connections are mutual — both people must confirm. You can remove a connection at any time.
• Invite codes are for personal use. Posting them publicly or selling them is a violation of these terms.

7. Subscriptions and payments

A/SIDE offers a free tier and paid Pro tiers (Individual and Family).

• Free — all features, with 7 days of feed and message history.
• Pro Individual — $4.99/month or $49.99/year. Unlimited history for one person.
• Pro Family — $14.99/month or $149.99/year. Unlimited history for up to 6 people via Apple Family Sharing or Google Play Family Library.

Subscriptions are billed through the Apple App Store or Google Play Store. We do not handle payment information directly. Pricing is subject to change — we will notify you before any price increase takes effect on your next renewal.

You can cancel your subscription at any time through your device's App Store or Play Store settings. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

There are no ads in any tier, free or paid.

8. Privacy

Your privacy matters to us. Please read our Privacy Policy for details on what data we collect, how we use it, and how we protect it. The Privacy Policy is part of these terms.

9. Infrastructure

A/SIDE runs on independent infrastructure (DigitalOcean) in the United States. We do not use Amazon Web Services, Google Cloud, or Microsoft Azure. Your data is not stored on big-tech servers and is not part of any big-tech data pipeline.

10. Intellectual property

The A/SIDE name, logo, and app design are owned by Lab 1908. You may not use our trademarks without written permission. The app is provided as a service — you do not acquire any ownership interest in the software.

11. Availability and changes

We aim to keep A/SIDE running reliably, but we do not guarantee uninterrupted access. We may update the app, modify features, or discontinue features at any time. If we make changes that materially affect your use of the service, we will give you reasonable notice.

12. Termination

• By you: You can delete your account at any time from Settings → Delete Account in the app, or by emailing hello@lab1908.com. Deletion removes your profile, posts, messages, and all associated data.
• By us: We may suspend or terminate your account if you violate these terms. If we do, we will tell you why (unless prohibited by law). We won't delete your data immediately — you'll have a reasonable window to export or request your content before permanent deletion.

13. Limitation of liability

A/SIDE is provided "as is." To the fullest extent permitted by law, Lab 1908 is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of A/SIDE.

Our total liability for any claim arising from these terms or your use of A/SIDE is limited to the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.

14. Dispute resolution

If you have a dispute with us, please email hello@lab1908.com first. We'll try to resolve it informally. If we can't, any legal action must be brought in the state or federal courts located in Minnesota, and you consent to the jurisdiction of those courts.

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

15. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you in the app or by email at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance of the updated terms.
